US Court Orders Freedom of Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without legal authority.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling charges, he was detained in immigration detention.
In her order, the court noted that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
